R. Brian Shutt, Senior Associate

A former City of Delray Beach City Attorney, Mr. Shutt has extensive experience representing local governments in virtually all facets of local government law, including planning and zoning, code enforcement, contractual negotiations and disputes, land use issues, drafting of ordinances and resolutions, public records and Sunshine Law compliance, and code of ethics compliance. He also has significant experience providing advice and counsel regarding various labor and employment issues, including termination, disciplinary, and performance decisions; the development of personnel policies and procedures; Family and Medical Leave Act and Fair Labor Standards Act compliance; and responding to charges of discrimination filed with the United States Equal Employment Opportunity Commission. 

His litigation experience includes defending claims of alleged civil rights violations, personal injury, and employment discrimination, alleged excessive use of force by law enforcement, and claims relating to the enforcement of municipal ordinances.

He is one of fewer than 250 attorneys Board certified by the Florida Bar in the area of City, County, & Local Government Law.

Education and Background

Mr. Shutt earned his law degree from Nova Southeastern University and his undergraduate degree in Civil Engineering from Virginia Tech.

Mr. Shutt joined the Firm after nearly 20 years with the City of Delray Beach -- the first 15 years as an Assistant City Attorney and the remainder of his tenure as the City Attorney. During this time, he provided advice, counsel, and representation on behalf of the City with respect to a wide range of issues, claims, and disputes. He also represented the City's Site Plan Review and Appearance Board, Board of Adjustment, Historic Preservation Board, Planning and Zoning Board, and Code Enforcement Board. Mr. Shutt was also responsible for reviewing all agenda items for legal sufficiency, as well as acting as board counsel for the City Commission.
